These Terms of Use govern access to openheartkollective.com, operated by Open Heart Kollective Co. LLC ("OHK"). By using the site, you agree to these terms. If you do not agree, do not use the site.

Development-stage site

The apparel, imagery, prices, descriptions, release timing, and availability shown on this site may be concepts or prototypes. They are not offers for sale unless a checkout page expressly states otherwise. Final products may differ after sampling, testing, vendor review, and approval.

Voting and priority list

Votes and expressions of purchase interest are nonbinding and do not guarantee production, inventory, pricing, early access, or the ability to purchase. OHK may evaluate votes together with feasibility, quality, cost, safety, and brand considerations. You are responsible for providing accurate contact information.

Communications

When you opt into email, OHK may send development, voting, launch, and product messages. You may unsubscribe at any time. If you separately opt into texts, you authorize recurring automated or non-automated marketing messages to the number provided. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages.

Intellectual property

The OHK name, Wear Your Heart language, artwork, marks, photographs, videos, concepts, layouts, copy, and site design are owned by or licensed to OHK and protected by applicable law. You may view and share official site links for personal, noncommercial purposes. You may not reproduce, sell, scrape, alter, impersonate, or commercially exploit site content without written permission.

Acceptable use

You may not interfere with the site, bypass security controls, submit malicious code, automate false votes or signups, misrepresent identity, infringe another person’s rights, or use the site unlawfully. OHK may restrict access or disregard activity reasonably believed to be fraudulent or abusive.

Third-party services

The site may link to TikTok and other third-party platforms. Their services and privacy practices are controlled by them. OHK is not responsible for third-party content, availability, or conduct.

Disclaimers and limitation

The site is provided “as is” and “as available” to the fullest extent permitted by law. OHK does not promise uninterrupted operation or that every concept will become a product. To the fullest extent permitted by law, OHK will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this development-stage site. These terms do not exclude rights that cannot legally be waived.

Governing law

These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. Any dispute not subject to a mandatory nonwaivable forum will be brought in an appropriate court located in Oklahoma County, Oklahoma.
